An internal note from U.S. Immigration and Customs Enforcement (ICE) dated May 12, 2025, authorizes officers to forcibly enter homes without a judicial warrant. According to the memo, they can do so with an administrative order (form I-205) but this order only allows detention in public or work places, not forced entry into a private home. Unfortunately, the note states that if entry is refused, officers are authorized to use force to open the door after notifying their intention, and may do so from 6 a.m. to 10 p.m.
However, an administrative order (such as a deportation order) only permits detention in public or work places, but does not permit forced entry into a private house without the consent of the tenant or owner. Warning: opening the door may be misinterpreted as consent. If they have a valid court order, then have them run it under the door to inspect it before opening the door. Once verified, say "I do not consent to any search beyond what is stipulated in the order".
Privacy is important to preserve freedom in society. No one should have the ability to kick in the wrong door and say ... sorry...! What about material damage and psychological harm? Should the authorities be allowed to endanger the peace and property of innocent people on account of an irresponsible mistake?
